General terms and bookingconditions for individual customers at Gîte Mozaïk in Louvain-la-Neuve

Subject
- These general terms and conditions define the rights and obligations of the parties in the context of any reservation made with the ASBL Gîte Mozaïk (hereinafter "the ASBL"). All bookings are subject to acceptance of these general terms and conditions, as well as the internal House Rules and Regulations charter (hereinafter referred to as House Rules).
- Any deviation from these conditions or the House Rules must be the subject of a prior written request and must be recorded in writing or by email. Where applicable, a change in rates may be applied.
- The customer's agreement to these general conditions comes into effect at the time of written confirmation of the booking: by email, by a signed contract or on receipt of the deposit or the full amount of the reservation. No reservation is possible without this agreement. The customer has the option of saving and printing these general terms and conditions.
Scope of application
- These terms and conditions apply to all reservations made by individual customers through the website www.gite-mozaik.be (or www.kaleo-asbl.be), by email, by telephone or at the reception of the Gîte Mozaïk.
- An individual customer (hereinafter "customer") is any person who makes a reservation for a maximum of 9 people. Any reservation made for 10 people or more is considered a group reservation and is subject to the General terms and bookingconditions for groups.
Booking conditions
- Access to the Gîte Mozaïk is reserved for active members or affiliates of the Kaleo network. A membership card, valid for one calendar year for all accommodations in the Kaleo network, must be purchased.
- A reservation becomes final upon receipt by the ASBL of the full payment for the reservation. This payment is due within 10 days of confirmation of the booking request, failing which the ASBL reserves the right to cancel the reservation automatically.
- In the case of a late booking and/or a booking made directly at the reception, the balance of the booking must be paid no later than the time of check-in.
- Reservations are accepted for a maximum duration of 7 nights. At check-out, the reservation may be extended for a maximum duration of 7 nights, subject to availability.
- A minimum number of nights may be required during certain periods.
- All guests must show proof of identity on arrival.
Specific conditions for Shared Rooms (dormitories):
Shared rooms are reserved for people under the age of 26 and/or for people on presentation of a valid student card.
Prices and method of payment
- Prices for overnight stays may vary at any time, particularly according to the season. However, an identical price - that of the first night - is applied to all nights of the same stay.
- Prices are fixed at the time of confirmation of the reservation. They are expressed in euros and include all taxes.
- The balance of the booking is automatically due within 10 days of confirmation of the booking. Any amount due for additional consumption or services is payable on the day of departure at the latest.
- All amounts must be paid in euros. Cash payment is accepted for bookings of less than €300. Bank transfers and bank card payments (including credit cards) are accepted. Bank checks are not accepted. Any bank charges are at the customer's expense.
Late arrival
- For all late arrivals, please contact the gîte by telephone or e-mail at least 1 hour before reception closes so that access arrangements can be made.
- If the guest does not inform the gîte of his/her arrival outside reception hours, the gîte does not guarantee access to the building and no refund will be made. If the night guard is able to provide access, a fee of 15€ will be charged.
Cancellation or modification
- The customer does not have the right of withdrawal.
- Any request for cancellation or modification must be made in writing (by registered post or email) at least 7 days before the start of the stay. If this deadline is not met, no refund, cancellation or modification will be possible, unless expressly agreed otherwise by the ASBL.
- Any modification accepted by the ASBL will incur administrative costs corresponding to 10% of the amount of the reservation.
- Any cancellation accepted by the ASBL will incur an administrative charge of €10.
- In the event of a "no show" (a customer who has not turned up and has not cancelled their reservation), the full amount of the reservation will be payable by the customer. Arrival after the unannounced check-in time will be considered a "no show".
- If the customer interrupts his/her stay, no refund will be made.
- Where applicable, refunds will only be made by bank transfer.
Cancellation or modification by the ASBL
- If the ASBL is unable to provide the agreed services, it may offer the customer an arrangement of equal or better quality without any change in price. Any price difference resulting from this arrangement will be charged to the gite. If no arrangement is possible, only the sums paid will be reimbursed.
- When an event beyond the control of the ASBL prevents it from providing the agreed services, or in the event of force majeure, the ASBL may cancel the reservation and provide a refund of the amounts paid.
Accidents, theft and all other damages
- The property is deemed in good and complete condition at the beginning of the stay. The customer is obliged to directly communicate any malfunction or damage to the manager or to their representative.
- Damage caused to buildings and equipment by guests of the gîte are to be paid for by and will be invoiced to the customer. To do this, the gîte will charge the customer the total cost of damages caused, based on an estimate, plus a penalty fine of 20% of the cost of the damage.
- The gîte is not responsible for any cases of theft or damage to personal belongings during the stay.
- The gîte cannot under any circumstances be held responsible for accidents or damage outside of its legal liability. More specifically, the gîte cannot be held responsible for services provided by third parties, inside or outside its property, ordered by the gîte on behalf of its customers.
Maintenance of the accomodation and hygiene
- Guests are asked to carry out a number of tasks to ensure the property is kept clean and tidy:
- The premises are kept in a state of overall cleanliness. Cleaning materials are made available for this purpose.
- Instructions regarding the sorting of waste and the region's specific rules on this subject must be strictly adhered to.
- The available spaces are kept tidy.
- At the end of the stay, the sheets should be put into the wash bins available on each floor, and blankets should be folded and left on the beds.
- For hygiene reasons:
- A protective cover, duvet cover and pillowcase are supplied for each bed and must always be used.
- It is strictly forbidden to smoke inside the gîte, in accordance with the Royal Decree of 19th January 2005.
- Animals are not allowed, with the exception of guide dogs.
- The size of the group can in no case exceed the number of beds available. The furniture cannot be moved under any circumstances.
- Misuse of fire alarms will result in a fine of €250. In the event of an unnecessary call-out of the emergency services, the costs will be charged to the customer. Any modification to the security measures of the building or its occupants (obstruction of fire doors, changes to the alarm system, etc.) will result in the immediate eviction of the gîte, without compensation.
Surroundings of the accomodation
- So as to be respectful towards our neighbours, a quiet period operates in and around the gîte between 10pm and 7am.
- Any use of amplified sound systems is subject to the gîte's authorisation and must comply with the Royal Decree of 24th February 1977 (announced 26th April 1997). In cases of non-compliance with this clause, the gîte reserves the right to evict guests without compensation.
- Out of respect for the neighborhood, noise disturbances are not tolerated during the night. In the event of the first intervention by the manager or their representative, a fixed amount of €25 will be charged to the customer. In case of multiple interventions by the manager or their representative and/or the police due to noise disturbances, a fixed amount of €250 per intervention will be charged to the customer.
Validity and modification of these conditions and prices
- The invalidity of any of the provisions of these conditions shall not affect the validity of the other provisions.
- These terms are subject to modifications. The customer must read them before making any new reservation.
- In the event of a change in the price or terms and conditions, the customer has the right to request a cancellation of their stay free of charge, by sending a registered letter within 7 calendar days of notification of the change. In the event of such a cancellation request, the gîte has the right to refuse by maintaining the old rates and terms & conditions for the stay in question.
Dispute
- Any amount not paid at the due date produces interest, automatically and without notice, at the contractual rate of 12% per annum and is increased, automatically and without notice, by a flat-rate penalty of 15% to cover administrative costs, with a minimum fee of €50.
- In the event of non-compliance with the general terms and conditions of the booking contract or the house rules, a damage or penalty fee may be claimed.
- Complaints relating to the services provided cannot be accepted if they are not received in writing by the hotelier within 7 days of the services being provided.
- In the event of a dispute, the courts of the judicial district of Brabant Wallon shall have jurisdiction. Belgian law applies.
